About Preparing an Affidavit in support of a common-law couple

The purpose of this Affidavit is to provide proof/evidence to the immigration officer that you are a witness to a genuine, real common-law relationship, marriage like relationship and that it is not a scam.

We just need to know what you truly know, as you will be sworn by the commissioner for oaths or equivalent.

Please consider the following:

  1. First establish who you are

Your full name, Date of birth, Address, Phone number, Occupation, Employer.

  1. Establish how you know one of the spouses?

How do you know the spouse you are signing this affidavit for?

  • You are a parent or sibling or other family status or

  • You are a friend who knows these people well or

  • You are an employer, a priest, colleague, etc. who know these people

If a friend, how long have you been friends? Who were you friends with first?

  1. Establish how you know the other spouse and when

What do you know of this couple?

  • How and when did you meet the spouse of your friend or sibling?

  • They have lived together continuously since ….

  • They live with each other as husband and wife

  • They live at this address: 123 Main Street, Calgary

  • If applicable, they also lived at this address previously: 456 Centre Street, Calgary

  • Where do they work? What is their occupation

How do you interact with this couple? What do you do together?

  • Play golf, baseball, hockey, etc.

  • Play cards

  • Enjoy each other’s company with dinners, outings, etc.

Remember that having genuine home-grown letters has a much more personal feel to it.

I SWEAR TO THE FOLLOWING:

I am writing in support of SPONSOR NAME and APPLICANT NAME application for sponsorship and permanent residency.

I have known SPONSOR since February of 2005. We were co-workers at XXX from 2005 to 2010. We worked closely together and became good friends.

I first met APPLICANT at a company Holiday Party in the winter of 2005. He became friends with my husband NAME, and together we have all four met up socially, at various parties and functions.  They have been to our house, and met my parents and grandmother several times. We have also attended baseball games together. 

In 2009, when NAME and I were expecting our son, NAME, SPONSOR and APPLICANT attended our baby shower. 
I have known about SPONSOR and APPLICANT’s relationship since SPONSOR and I first met. We often talked and chatted about our home lives while we worked. Over the years of working together, and our developing friendship, I had the opportunity to get to know more and more about SPONSOR and APPLICANT relationship and I know it to be a marriage-like relationship.

I believe they are very much in love, and are a great couple. They live like husband and wife. 
I am happy to support my friends’ application for sponsorship and permanent residency in Canada.
